Back taxes run on a different clock. Milwaukee County uses the in rem procedure in section 75.521 of the Wisconsin Statutes to enforce tax liens, and in the standard case a county may begin that action once a lien has been delinquent for 2 years. Where a city's razing and site-restoration costs are included in the amount due, the wait drops to 1 year โ a property with a raze order attached can reach tax foreclosure twice as fast. Once the action is published there is a redemption period of at least 8 weeks, and redeeming means paying the unpaid liens plus interest, penalties, the county's costs, and a share of the publication costs. The payoff is always more than the original tax bill, and it grows.

Inherited property is the situation we see more than any other, and the first question is usually about probate. In Wisconsin, when the property subject to administration does not exceed $50,000 in gross value, an estate can often be settled by transfer by affidavit instead of a full probate. That can be the difference between a months-long court process and a comparatively simple filing, so establishing the value of the estate is the first thing to do.
Real estate carries extra steps that bank accounts do not. Only an heir, a trustee of the decedent's revocable trust, or a former guardian may transfer real property by affidavit, and the affidavit has to be recorded with the county Register of Deeds. And being named executor in a will is not by itself enough โ a person signing only as the personal representative nominated in the will may not use the affidavit route to transfer real estate.
